Terms of Service

1. Acceptance of these Terms

By creating an account, downloading, installing, or otherwise using Resicheq (the "Service"), you ("User", "you") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Egocolors Limited ("we", "us", "our").

2. Description of the Service

Resicheq is a software tool that helps users record and visualize the days they spend in different countries, calculate day counts toward common tax-residency thresholds (such as the 183-day rule and the US Substantial Presence Test), and export reports of that data.

⚠ Resicheq is NOT a tax advisor. The day counts, residency calculations, and reports produced by Resicheq are informational tools only. They do not constitute tax, legal, financial, or immigration advice. Tax residency rules vary by jurisdiction and are subject to interpretation. Always consult a qualified tax professional before making decisions based on any Resicheq output. We accept no liability for tax filings, penalties, or assessments resulting from your use of the Service.

3. Accounts

To use most features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account credentials
Notify us immediately of any unauthorized access to your account
Be at least 16 years old (or the age of digital consent in your jurisdiction)

You are responsible for all activity that occurs under your account.

4. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You do not acquire any ownership rights in the Service or its software.

5. Pricing and payment

Resicheq offers a free tier and a one-time-payment Pro tier. The current pricing is shown on the Resicheq landing page. The Pro upgrade is a one-time purchase, not a subscription. Refunds are handled according to the policy of the platform you purchased through (Apple App Store, Google Play, or our web checkout).

6. User obligations

You agree NOT to:

Use the Service for any illegal or fraudulent purpose
Submit false or misleading data to manipulate the Service or other users
Reverse engineer, decompile, or attempt to extract source code from the Service
Use the Service to harass, abuse, or harm any other person
Attempt to gain unauthorized access to other users' accounts or our systems
Interfere with or disrupt the Service or its servers
Use automated systems (bots, scrapers) to access the Service without our permission
Resell, sublicense, or commercially exploit the Service without our written consent

7. Referral and rewards program

If you participate in the referral or rewards program, you agree to use it in good faith. We reserve the right to modify, suspend, or terminate the rewards program at any time, and to invalidate points or rewards earned through fraudulent or abusive means.

8. Third-party services

The Service integrates with third-party services including Google Firebase, Google Sign-In, Phantom Wallet (Solana), and OpenStreetMap tile providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, content, or actions of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
Day counts or tax residency calculations are accurate or complete
The Service will meet your specific requirements

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EGOCOLORS LIMITED AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD 50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Egocolors Limited from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third-party rights.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.

13. Governing law and disputes

These Terms shall be governed by the laws of [Jurisdiction TBD — to be confirmed by Egocolors Limited counsel], without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app and on this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
